Nike Korea, LLC (as a location information provider under Article 5 of the Act on the Protection and Use of Location Information, etc (the “Act”)) and Nike, Inc. (as a location-based service under Article 9 of the Act) (collectively, “Nike” or “we”)collect and process personal location information in accordance with relevant laws, including the previously stated Act.
Purpose of Processing Personal Location Information and Retention Period
We use personal location information to 1) provide location-based services you request, 2) to operate, improve and maintain business products and services, 3) to protect our or other’s rights, property and safety, 4) for general research and analysis purposes, 5) for our legitimate interests as a business, to comply with a legal obligation, or to protect your vital interests, and 6) to communicate information (with your consent) about our products, services, events and for other promotional purposes. Nike will retain personal location information until the purpose of retaining personal location information has been achieved (unless a longer retention period is required by applicable law).
Basis for retention and retention period of materials confirming collection, use, and provision of Personal Location Information
Based on Article 16, Paragraph 2 of the Location Information Protect Act, the Company automatically records/stores in the location information system the verificaion materials regarding the collection/usage/provision of location information for purposes such as settling claims with coustomer and to respond to customer complaint. Said data will be stored for more than 6 months.
Procedure and Methods of Destruction of Personal Location Information
We destroy your personal location information once the retention period is expired or based on our agreement with you. When destroying personal data, Nike will take technically reasonable measures to make the personal location information irrecoverable or irreproducible in accordance with Nike’s internal policies.
Provision of Personal Location Information to Third Parties
We provide your personal location information to third parties when you have provided your consent. Nike may provide your personal location information to other third parties without consent: (i) to the extent necessary to comply with a government request, a court order or applicable laws; (ii) where specific provisions exist in the Act on the Protection, Use, Etc. of Location Information or other applicable laws; and (iii) where the provision of personal information to a third party is permitted pursuant to court precedents or interpretation of relevant authorities. In case Nike provides your personal location information to a third party that you designated, it will immediately notify you, the data subject of the personal location information, of the third party recipient, date and time of provision, and purpose of such provision.
Rights and Obligations of Persons with the Obligation to Protect Children of Eight Years or Under, Etc., and Method of Exercising the Rights and Obligations
Currently, Nike is providing services using personal location information (“Location-based Services”) for users over 14 years. In case Nike provides Location-based Services for children of eight years or under, Nike will follow the Act on the Protection, Use, Etc. of Location Information.
In case a person with the obligation to protect any of the following users consents to collection, use, or provision of personal location information of such user for protection of the life or body of such user to use, Nike considers that the user’s consent has been obtained from:
A person with the obligation to protect such user who intends to consent to collection, use, or provision of personal location information for protection of the life or body of such user to use the Location-based Services should submit a written consent to Nike with attachment of a document proving that he/she has such capacity. Upon providing the consent to collection, use, or provision of personal location information of such user, the person may fully exercise the rights of the relevant data subject of the personal location information concerned.
