2.14 To Operate, Improve and Maintain our Business, Products and Services

We use the personal information you provide to us to operate our business.  When you use our functions or enjoy our services on Nike sites, Apps or WeChat mini programs, we will collect your personal information for purposes of accounting, audits and other internal functions.  We may use personal information about how you use our products and services to help us diagnose technical and service problems and administer our websites, Apps and WeChat mini programs.

2.15 For General Research and Analysis Purposes

We use data about how you use our websites, Apps and WeChat mini programs to better understand customer behavior or preferences.  We may use information about how you search products on Nike websites, Apps as well as WeChat mini programs to better understand the best ways to organize and present product offerings in our storefront.  

2.16 To Protect Our or Others' Rights, Property or Safety

In order to improve the security of your use of Nike’s products/services, protect the personal and property safety of you or other users or the public, better prevent security risks such as phishing websites, frauds, network vulnerabilities, computer viruses, network attacks, network intrusions, etc., and more accurately identify violations of laws and regulations or relevant protocol rules, we will obtain your device information (UUID, Android ID, OAID, IDFA, IDFV etc.), device account information, network information (IP address, MAC address, SSID etc.), application information (application installation list), browser information (including browser types), sensor information etc.  Based on this information, we will comprehensively determine, detect and prevent security incidents, including prevention or detection of fraud, abuse, illegal use, violations of our Terms of Use and/or Terms of Sales, and execution of court orders, government requests or applicable laws.

2.17 Device OS Permissions

In order to ensure the normal implementation of the relevant business functions, part of our Apps and mini programs need call the corresponding necessary permissions according to the specific usage scenarios and ask you via a pop-up window before the call. You can choose to turn off some or all of the permissions in the device or Apps, mini programs’ settings, which may cause the corresponding business functions to be unachievable or unable to achieve the desired results

In order to ensure that users of some of our Apps (currently only SNKRS China App) can receive broadcast information pushed by the App when they are closed or running in the background, the (self-start) capability is necessarily needed. There will be a certain frequency of broadcasting through the system to wake up the self-start or associated startup behavior of the App, which is necessary for the App to provide functions and services.

2.18 Exceptions to Obtaining Consent

In accordance with laws and regulations, we may collect and use your personal information without your consent in the following circumstances:

(1) Necessary for the purpose of entering into and performing a contract to which you are a party;

(2) Necessary for the performance of statutory duties or statutory obligations;

(3) Necessary in response to public health emergencies or in emergencies to protect the lives, health and property safety of you or others;

(4) Implementing news reporting, public opinion supervision and other acts for public interest, processing your personal information within a reasonable range;

(5) Within a reasonable scope in accordance with the provisions of this Law, disclose your personal information that has been disclosed by you or legally disclosed by others;

(6) Other circumstances stipulated by laws and administrative regulations.

III. How We Protect the Personal Information of Minors    

Please be aware that we protect the personal information security of minors in accordance with the requirements of Chinese laws and regulations. Our products and services are mainly for adults, and we do not intend to collect personal information from minors. However, because date of birth is not the necessary information we need to provide basic functions, in some cases we cannot identify the age of the users. Therefore, we require minors under the age of 14 not to provide us with their names, contact addresses, telephone number and other personal information. If we have evidence to prove that you have violated the aforementioned requirements, we have the right to stop providing Nike products/services to you immediately.

If you are the parent or guardian of a minor, and have any questions, comments and concerns about personal information related to the minor you are monitoring, please contact us by following the method published in Article 10 of this Privacy Policy, “Questions and Feedback”.

IV. How We Authorize to Process, Share, Transfer and Disclose Your Personal Information    

4.1 Authorize to Process

In order to better implement the functions of our products and services, some functions may be provided by our technical service partners, and we may authorize others to process some of your personal information. We will sign meticulous confidentiality agreements with third-party companies, organizations and individuals who we authorize to process your personal information, specifying purposes, terms, methods of processing, types of personal information, protection measures, rights and obligations of both parties, and we will supervise the personal information processing activities of authorized third parties. Once the authorization relationship is terminated, we will require the authorized third parties to return or delete your personal information. We will mainly authorize the following third parties to assist us in providing services:

A. Advertising Service Providers: In order to provide you with better services, we may provide your personal information to advertising service partners;

B. Analytical Service Providers: In order to better analyze your use of Nike’s products and/or services, we may provide service providers information with regard to quantity of Nike members, locations, activities and other data, but we will only provide these partners with statistics that do not identify you (for example, “25 year-old male in Hangzhou, likes to buy running shoes”);

C. Logistics Service Providers: In order to fulfill the purpose necessary to fulfill the contract between you and us to purchase and use Nike products and services, we will authorize third-party warehousing, logistics and service providers to provide you with logistics services. We may provide them with the name of recipients, mailing addresses and mobile phone numbers of recipients to complete the delivery of the products. If you do not provide such information, our logistics service partners will not be able to ship the goods to you.

D. Third-party software tool development kit (SDK): In order to better serve you, we use third-party SDKs. These third-party SDKs may collect your personal information while providing you with more comprehensive services. We will adopt necessary methods to control the collection and use of your personal information by these third-party SDKs to ensure that your personal information is effectively protected. Please refer to Nike’s third-party SDKs catalog for details on the name and type of third-party SDKs, the type of personal information collected, the purpose of collection, and links to the third-party privacy policies.

4.2 Sharing

In order to realize the functions of our products and services, we may provide your personal information to other personal information processors, mainly including:

(1) Payment service providers: In order to fulfill the purposes necessary to fulfill the contract you entered into with us for the purchase and use of Nike products and services, we need to provide your order number, order amount and payment time to WeChat, Alipay and UnionPay, so as to confirm your payment order and complete the payment of the order:

(2) Affiliated companies: Other Nike entities shall share for the purposes stated in this Privacy Policy under the conditions of this Privacy Policy. 

(3) Sharing of the following items with other third parties to the extent necessary: (i) To comply government requirements, court orders or applicable laws; (ii) To prevent the illegal use of Nike products/services or violation our Terms of Use, Terms of Sales and other policies; (iii) To defense against third-party claims; and (iv) To assist in the prevention of fraud or investigation (such as counterfeiting). 

In addition to the above, if we provide your personal information to other personal information processors, we will inform you of the recipient’s name or full name, contact information, purpose of processing, manner of processing and type of personal information. If laws and regulations require us to obtain your separate consent, we will obtain your separate consent as required.

4.3 Transfer

Without your consent, we will not transfer your personal information to third-party companies, organizations or individuals. If it is necessary to transfer for reasons such as merger, division, dissolution, bankruptcy declaration, etc., before the transfer, we will inform you of the name or full name and contact information of the recipient and require the recipient to continue to perform the obligations as personal information processor. If the recipient changes the original purpose and method of processing, we will require it to obtain your consent again in accordance with the law.

4.4 Public Disclosure

We will not disclose your personal information that we process unless you give your separate consent.

When you use certain social functions of our website, Apps, WeChat mini programs and other channels, you can establish public profiles containing information such as your account name. You can also provide public comments on product in our relevant product interface. You can also share content with your friends or the public, including information about your Nike activities. We recommend that you use the tools we provide to share information so as to control the information you provide or disclose. If so, we can delete your messages, comments on our Nike Tmall stores if you require us to delete them.

Some of our web pages and Apps allow you to interact with a wide variety of other digital products and services.  For example, our websites and Apps can integrate with third-party devices for activity tracking, social networks, music streaming services and other digital services. 

If you choose to connect your Nike member account with a third-party device or account, your privacy rights on third-party platforms will be governed by their respective policies.  For example, if you choose to share your Nike activity on third-party social media platforms, the policies of those platforms govern the data that resides there. Our website and Apps may provide links to other (third-party) websites and apps for your convenience or information. Linked sites and Apps have their own privacy notices or policies, which we strongly encourage you to review. To the extent any linked websites or apps are not owned or controlled by us, we are not responsible for their content, any use of the websites or Apps, or the privacy practices of the websites or Apps.

Please be informed that: If you use the above functions to actively disclose and share your relevant information to third-party platforms (such as WeChat friends / WeChat circle / QQ /, etc.),in such cases, the shared information will be immediately and widely disseminated. Once you have shared such information, it is difficult to ensure that when you need to delete the information, the information you shared is completely deleted in all Internet platforms that receive forwarding. In some cases, even if you delete the information you share or disclose from our website, App, WeChat mini programs, such information may still be kept in a domain accessible to the public, and can still be cached, copied or stored independently by other users or third parties not affiliated with us and not controlled by us, and stored in a domain accessible to the public through other users or such third parties.

V. How You Exercise Your Personal Information Subject Rights 

5.1 Access, Complete or Correction of Your Personal Information

You have the right to access your Nike member account to view, completeor correct your personal information at any time through the Nike App. If you find that your personal information we collect, store, use, or disclose is incorrect or needs to be updated, or under other circumstances as required by laws and regulations, you can request to correct your personal information, but in any case, you need to ensure the authenticity and accuracy of the data you provide. If any loss is incurred due to the incorrect, inaccurate or incomplete information provided, you need to assume responsibility for this.

If you wish to access, complete or correct your other personal information, or encounter difficulties in exercising the aforementioned rights, you can send an email to privacy@nike.com, and we will respond to your request in a timely manner after verifying your identity, unless otherwise stipulated by laws and regulations or otherwise stipulated by this Privacy Policy.

5.2 Copy and Transfer

You have the right to copy or ask to transfer your personal information. You can send an email to privacy@nike.com, and we will provide it in a timely manner. If you request to transfer your personal information to your designated personal information processor, we will provide a route to transfer if the conditions specified by the competent authority are met.

5.3 Deletion of Your Personal Information

In the following circumstances, we will actively delete your personal information. If we do not delete it, you have the right to request us to delete it:

(1) The processing purpose has been realized, cannot be realized, or it is no longer necessary to achieve the processing purpose;

(2) We stop providing Nike products or services, or the retention period has expired;

You hereby agree that once the deletion request is responded to, your personal information will be deleted or anonymized, unless otherwise stipulated by laws, regulations or regulatory documents. Please be aware that we may not delete the corresponding data from the backup system immediately, but will delete it when the backup system is updated.

5.4 Restriction on the Processing of Your Personal Information

5.5 Withdrawal of Your Consent

With regard to your personal information that we have collected based on your consent, you can give or withdraw your authorization and consent at any time. You can change the scope of your consent for us to continue collecting your personal information or withdraw your consent by deleting information, turning off device functions, etc., or by sending an email to privacy@nike.com. You can also withdraw all authorizations for us to continue collecting your personal information by logging out of your account. However, please note that we may not be able to respond to your request to withdraw your consent or authorization for certain types of personal information, such as data necessary for the basic functions of Nike products/services or information necessary for us to fulfill our obligations under the applicable laws and regulations. In addition to the circumstances where we are unable to respond to, we will no longer process the corresponding personal information after you withdraw your consent or authorization, but your decision to withdraw your consent or authorization will not affect our previous personal information processing activities based on your consent or authorization.

5.6 Cancellation of Your Member Account

If you wish to cancel your Nike member account, you may delete your account by any of the following methods:

(1) Cancellation by yourself: Log in to the Nike App by using the Settings > Delete Account and complete the account cancellation;

(2) Call customer service: Call Nike’s official customer service at the contact information: 400-880-6453.

After receiving your request to cancel your account, we will delete your account and personal information within 15 working days. Please note that your member account cancellation is irreversible. Therefore, we recommend that you carefully choose to cancel your account.

5.7 Responding to Your Request

When you send email to privacy@nike.com and request to exercise the user rights stated in Articles 5.1 - 5.6 of this Privacy Policy , to ensure security, we may ask you to submit relevant proof to verify your identity before processing your request. In regard to your request, we will, in principle, complete the verification and processing within 15 working days after receiving your request.

In regard to your reasonable request, we do not charge fees in principle. We may provide an explanation to you on the reasons for information that is not directly related to your identity or unreasonably duplicated data, or that require too many technical means (for example, the need to develop a new system or fundamentally change current practices), risk or unrealistic requests to the legitimate rights and interests of others. If you have any questions, comments or suggestions about the rights of your personal information subject, or request us to explain this Privacy Policy, you can also contact us through the method in Article 10 of this Privacy Policy. We will provide an explanation to you in time.

VI. How to Protect Your Personal Information

In the event of a personal information security incident, we will respond in accordance with our incident management plan. We will also report the security incident to the competent authority in accordance with applicable laws. We have used security precautions that meet industry standards to protect the personal information you provide from unauthorized access, public disclosure, use, modification, damage or loss of data. VII. How to Store Your Personal Information

Personal information collected and generated by us in China (for the purpose of this Privacy Policy, not including Hong Kong, Macau and Taiwan at this time) is stored in China. As a global multinational enterprise, Nike’s products, services and management adopt globally integrated standards to ensure business continuity and system security. At the same time, we will obtain separate consent (when necessary), complete the necessary security assessments (when required) by applicable laws and regulations or fulfill other data management responsibilities as required by laws and regulations.
