These Terms of Sale apply to your shopping, orders, purchases, and returns at NIKE-owned digital stores that enable consumer purchases through NIKE.com, SNKRS, or the NIKE app (Digital Stores). These Terms of Sale create a legally binding agreement between you and Nike Inc. and Nike Australia Pty Ltd (together “Nike”) (referred to as “NIKE,” “we,” “us,” or “our”).
NIKE may revise these Terms of Sale without notice by posting the revised Terms on www.nike.com.au (Website). The Terms of Sale posted on the Digital Store at the time you place your order will govern that purchase. Please read these Terms of Sale carefully and ensure the details of your order are complete and accurate before submitting it. If you believe there is a mistake, please contact us. NIKE’s Terms of Use and Privacy Policy are incorporated herein by this reference.
Please read these Terms of Sale carefully before ordering products online from the Digital Stores.
Nothing in these Terms of Sale excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by any applicable law which cannot lawfully be excluded or limited. This may include the Australian Consumer Law (ACL) which contains guarantees that protect the purchasers of goods and services in certain circumstances.
To make a purchase via a Digital Store, you must be at least 18 years old in Australia, or you must have consent from your parent or guardian.
Digital Stores are intended solely for NIKE to sell NIKE products directly to end consumers, and the purchase of products for resale is strictly prohibited. Purchase for resale means the purchase of NIKE products by someone who resells, or intends to resell, the NIKE product to others (consumers, businesses, or any third party). If NIKE believes you are involved in purchasing for resale, we reserve the right to take action, including but not limited to restricting sales, canceling your orders, or suspending or closing your account.
To complete your purchase at a Digital Store, you must provide your full name, email address, valid delivery address, and payment method to place an online order. You may need to adjust your device settings or enable your browser to accept functional cookies and pop-ups to use all the features of a Digital Store, including adding products to your shopping bag, and submitting your order.
When you submit an order, we will send an email acknowledging receipt of your order (Order Confirmation). Our acceptance of your order takes place when the products are shipped to you, and we will send a second email confirming that the products have been dispatched.
If we are unable to supply a product and we have not processed your order, we will inform you and will not process the order for that product. If we are unable to supply a product, and we have already processed your order, we will notify you and issue a refund.
Subject to your rights and our obligations under applicable laws, including the ACL, Nike reserves the right to decline to accept, process, or dispatch an order based on information contained on this Website that NIKE deems erroneous or inaccurate, including but not limited to out-of-date or incorrect pricing, shipping, payment terms, or return policies.
Sale of products and fulfillment of orders at a Digital Store is subject to availability and our discretion in managing inventory. Subject to your rights and our obligations under applicable laws, including the ACL, we explicitly reserve the right to limit, decline, or reject any sale or order for any reason (acting reasonably), without being liable for any damage or costs other than repayment of any amount received from you in relation to such sale or order, in situations including but not limited to:
The risk of loss for products purchased from NIKE will pass to you upon delivery by our carrier to the specified delivery address. Title to the products will not transfer to you until full payment has been received.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND WITHOUT EXCLUDING OR LIMITING ANY OF YOUR RIGHTS UNDER THE AUSTRALIAN CONSUMER LAW (ACL), NONE OF THE NIKE PARTIES WILL BE LIABLE FOR ANY DIRECT, SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION FOR ANY LOST PROFITS OR LOST DATA, THAT RESULT FROM YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, A DIGITAL STORE; OR FOR THE PERFORMANCE OF THE PRODUCTS PURCHASED THROUGH A DIGITAL STORE OR FOR ANY OTHER ACTIVITY IN CONNECTION WITH YOUR SHOPPING, ORDERS, PURCHASES, OR USE OF A DIGITAL STORE, EVEN IF NIKE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR ONLY REMEDY AGAINST NIKE IN CONNECTION WITH ANY DAMAGES ARISING FROM THE ABOVE, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND WITHOUT EXCLUDING OR LIMITING ANY OF YOUR RIGHTS UNDER THE UNDER THE ACL, IS TO STOP ACCESSING OR USING A NIKE-OWNED DIGITAL STORE. FURTHER IF NIKE IS FOUND TO BE LIABLE TO YOU FOR ANY DAMAGE OR LOSS WHICH IS IN ANY WAY CONNECTED WITH YOUR USE OF A DIGITAL STORE, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND WITHOUT EXCLUDING OR LIMITING ANY OF YOUR RIGHTS UNDER THE UNDER THE ACL, NIKE'S LIABILITY SHALL NOT EXCEED US$100.00.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND WITHOUT EXCLUDING OR LIMITING ANY OF YOUR RIGHTS UNDER THE ACL, NIKE PROVIDES ACCESS TO DIGITAL STORES “AS IS” AND “AS AVAILABLE”, WITHOUT ANY REPRESENTATION OR WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT ON ALL USES AND/OR PURCHASES. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW AND WITHOUT EXCLUDING OR LIMITING ANY OF YOUR RIGHTS UNDER THE ACL, ALL SUCH REPRESENTATIONS AND WARRANTIES ARE HEREBY EXPRESSLY DISCLAIMED. WITHOUT LIMITING THE FOREGOING, (1) NIKE DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, FOR ANY PRODUCT. NIKE FURTHER DISCLAIMS ANY WARRANTIES EXPRESS OR IMPLIED AS TO THE ACCURACY OR COMPLETENESS OF EACH PRODUCT INCLUDING, WITHOUT LIMITATION, PRICING, QUANTITY AND SIZING; (2) NIKE DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION POSTED AT NIKE STORES IS ACCURATE, COMPLETE, OR CURRENT OR THAT DIGITAL STORES WILL OPERATE WITHOUT INTERRUPTION, WITHOUT ERROR OR WITHOUT DEFECTS, BUGS, VIRUSES, OR OTHER HARMFUL COMPONENTS; AND (3) EACH OF THE FOREGOING DISCLAIMERS OF WARRANTY ARE ENFORCEABLE TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, BUT DO NOT EXCLUDE OR LIMIT ANY OF YOUR RIGHTS UNDER APPLICABLE LAW (INCLUDING UNDER THE ACL), AND DO NOT APPLY TO ANY PRODUCT OR MANUFACTURER WARRANTY EXPRESSLY OFFERED BY NIKE AND/OR ANY THIRD-PARTY MANUFACTURER OF MERCHANDISE.
You agree these Terms of Sale and any dispute between you and NIKE shall be governed in all respects by Oregon law, without regard to choice of law provisions, and not by the 1980 U.N. Convention on Contracts for the International Sale of Goods. Except where prohibited by applicable law, and without limitation to any statutory rights for consumers (including rights or remedies under the ACL) and which by law cannot be excluded, restricted or modified, you agree that all disputes, claims and legal proceedings directly or indirectly arising out of or relating to the Digital Stores (including but not limited to the purchase of NIKE products) shall be resolved exclusively in the state or federal courts located in Multnomah County, Oregon, USA.
NIKE may assign its rights and duties under these Terms of Sale to any party at any time without notice to you, unless notice is required by applicable law. However, this will not affect your rights or our obligations under these Terms of Sale. You may only transfer your rights or obligations under these Terms to another person if we agree in writing. NIKE’s failure to insist upon or enforce strict performance of these Terms of Sale is not a waiver of any of these Terms or NIKE’s rights. If we waive a default by you, we will only do so in writing, and that will not mean that we automatically waive any later default by you. You should always assume these Terms of Sale apply. If any court or relevant authority decides that any provision of these Terms of Sale is invalid or unenforceable, the remainder of these Terms shall continue to be enforceable.
You can find the available payment methods in the help section of the Website. We do not accept any method of payment other than those listed in the help section. Please do not attempt to pay by any other method than specified there. If you do, we will not be liable for any loss of payment or any other damages that may result from this action.
If you pay by credit or debit card, we will pre-authorize and hold the amount due when you place an order. Once your order ships, we will deduct the pre-authorized amount from your account. If we are unable to supply an order, we will release any pre-authorisation and hold on the relevant amount.
The product prices displayed on the Digital Stores are quoted in Australian dollars and inclusive of Goods and Services Tax as applicable. Shipping rates are applied per order. For details on shipping rates, see the help section of the Website.
The total price specified on the final checkout screen includes shipping costs. This price will be recorded in the Order Confirmation, which we recommend you print or download for future reference. Prices displayed on the Digital Stores may change from time to time, but changes will not affect any order which we have confirmed in an Order Confirmation.
If your local currency is not in Australian dollars, your bank or credit card issuer will apply the exchange rate and any fees according to the terms and regulations applicable to you and the bank/issuer of your credit or debit card. The exchange rate and any fees applied by the bank/issuer are beyond our control.
Please refer to the help section of the Website for the available delivery dates, times, and methods. We can only fulfill an order to a delivery address which is a home or office address in one of the regions listed in the help section of the Website. Please note, delivery dates and times are estimates only. We do not ship on certain public holidays. There may also be delays in preparing orders during peak periods and major NIKE sale events, including but not limited to Black Friday sales and Boxing Day sales. We will use all reasonable endeavors to deliver your order in accordance with the relevant delivery date, but we will not be liable for any late or delayed deliveries that are beyond our reasonable control.
Where possible, we try to deliver all products you have ordered at the same time. However, please note that because all products may not be available at the time of ordering and we are expecting more to come at a later date, an order for multiple products may result in split shipments. We reserve the right to split the delivery of your order if part of your order is delayed or unavailable. If we split your order, we will notify you of our intention to do so by sending you an email to the address you provided when placing the order. You will not be charged for any additional delivery costs. Delayed items will be dispatched as soon as stock becomes available. When an item is dispatched, we will inform you via email so you can track your order.
Once your order has been dispatched by us, you will receive a tracking number via email. Please allow up to 48 hours for your tracking details to be updated with our carrier.
If we don’t have a product in your order or an item is unavailable, it will be refunded. If all items in your order are unavailable, your order will be canceled, and you will be refunded.
To the maximum extent permitted by applicable laws, Nike disclaims all liability for any processing delays experienced during peak periods, including promotions and holiday periods.
Upon delivery, please inspect the packaging for damage. If the products appear damaged, please contact NIKE Consumer Services for assistance.
NIKE members get free standard shipping on all orders over $80. Non-member (or guest) purchases that exceed certain order thresholds, determined by NIKE in its sole discretion, may receive free standard shipping. See the Get Help pages posted on our Digital Store for order threshold amounts and their corresponding discounted delivery rates.

You may cancel any order free of charge and without giving us any reason, provided it has not yet been shipped within thirty (30) minutes from the time the order was placed. If you do not cancel an order within the thirty (30) minute window, the product(s) will be delivered to you in accordance with these Terms of Sale. You may then choose to return the product(s) once you receive them in accordance with the return procedure set out below.
Orders that are "Pending" or "On Hold" cannot be canceled.
At NIKE, we offer a 30-day return window from the date of delivery for all orders if you change your mind, with some exceptions (set out below). To initiate a return, please visit your Order Portal. Returns or exchanges made after 30 days will not be accepted, unless the product is faulty or damaged (see below).
For in-store purchases, please contact the store you purchased from directly to arrange a return. Please note that our store returns policies may vary—please contact the store directly if you have questions.
Returns for purchases made via Nike.com or the NIKE App must be completed through the returns portal on our website. In-store returns for purchases made via Nike.com or the NIKE App are not available. If you need assistance with the returns portal, please contact NIKE Customer Service on 1300 656 453.
Once your return has been initiated, please follow the instructions that have been provided to you during the returns process and send the items back within 7 days. Returns typically take 7-10 business days to reach us. Once your return is delivered to our warehouse, you’ll receive a confirmation email from our carrier (currently, Australia Post), followed by a notification from us when your refund is issued. Refund processing times vary depending on your payment provider.
NIKE will cover the cost of return shipping for NIKE Members. We will also cover the return delivery costs for faulty or damaged items (see below). Non-Members will be charged a $9.95 return postage fee, which will be deducted from the refund. Original shipping costs will not be refunded (except for faulty or damaged items).
Other than where products are faulty or damaged, products must be in new, unused condition, with all original protective materials, tags or stickers (if applicable), and in the original packaging. All returns will be subject to quality control checks. Refunds will be processed to the original payment method.
Once your return is confirmed as meeting the conditions of the return policy, we will issue a refund for the price you paid for the returned items (excluding shipping charges where applicable).
NIKE monitors return activity, and frequent or high-volume returns may, at our discretion, be considered a breach of these terms and declined.

If, in Nike’s opinion, a counterfeit product has been returned, Nike reserves the right to reject this return and provide no refund.
NIKE may change this policy at its discretion and will do so by updating these Terms of Sale in the manner described at the introduction to these Terms of Sale.
We do not offer exchanges for online orders. To exchange an item, you can place a new order for the item you want and return the unwanted item for a refund in accordance with our Returns Policy.
In-store purchases can only be returned in-store and cannot be returned by post or via the returns portal on the Website.
You have statutory rights that entitle you to return products if they are faulty or damaged or otherwise not in conformity with your order. In such cases, the purchase price and any shipping costs will be refunded. For instructions on returning faulty or damaged products, please visit the Returns section on the Get Help pages of our Digital Stores.
NIKE accepts credit cards (Visa, Mastercard, American Express, Union Pay, PayPal, PayPal Pay in 4, Afterpay, Klarna, Google Pay, and Apple Pay.
PayPal Pay in 4, Klarna, and Afterpay are available for products purchased via our Website. Products purchased using these services are eligible for a refund or an online store credit.

An Event Outside Our Control refers to any act or event beyond our reasonable control, including but not limited to strikes, lock-outs, or other industrial actions by third parties, civil commotion, riots, invasion, terrorist attacks or threats of terrorist attacks, war (whether declared or not), or threats or preparations for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disasters, or failure of public or private telecommunications networks.
If an Event Outside Our Control affects our ability to perform under these Terms of Sale:
a. We will make reasonable efforts to contact you as soon as possible to notify you.
b. Our obligations under these Terms of Sale will be suspended, and the time for performance will be extended for the duration of the Event Outside Our Control.
If the Event Outside Our Control impacts delivery of a product to you, we will arrange a new delivery date once the event is over. We may cancel your order on your behalf and issue you with a refund if an Event Outside Our Control occurs.
